To Frisk or Not To Shoot? Is That the Question or the Answer?

Donald Trump likes to accuse Hillary Clinton of plotting to eliminate the 2nd Amendment to the U.S. Constitution. That’s the Amendment that guarantees Americans the right to bear arms. But I seriously doubt that she’s even considering such a proposal because:

Currently 31 states allow folks to openly bear their arms in public while 8 states allow you to bear them in secret. All of the other states allow one or the other or both, as long as you’ve obtained a permit. So here in the United States we’re pretty much in love with our arms. And by arms, of course, I actually mean weapons and not those anatomical extensions on your shoulders.

Anyway, here in the U.S. we love our weapons so much that we have over 300 million of them on hand and available to the general public. And those are just the ones in our homes without even counting the ones in our stores!

Which is why I find it most unusual that every time someone is shot by the police the police always explain the shooting by saying, “They had a gun! so we had to shoot them! Or at least we thought they did” (which is almost the same thing police-wise) But as I’ve just explained, it’s not illegal to have a gun in the United States. In fact it’s so legal that almost every state allows them to be on your person when in public.

How do the police know if you have a legal permit to own that gun that you have, while they are shooting at you, if they don’t even bother to ask to see your permit before they start shooting? It’s always “He’s got a gun! He’s got a gun!” And then Blam, blam, blam, blam, blam! (they never, ever, just shoot once)

Why do we always assume that having a gun out in public  makes one a criminal, when it’s not a crime to have a gun out in public in all but 6 states? (and it’s legal in those 6 states too, with a permit) Have you ever wondered that? How come when one police officer shouts, “He’s got a gun!” The other officer doesn’t shout back, “Maybe he’s got a permit?” Or…”We’re in a state where it’s legal to have one in public!”

So why are the police always shooting people who possess a gun, or who they suspect of possessing one, when we live in a country where the 2nd Amendment to our constitution says that they are allowed to posses a gun and half the country is absolutely gaga over that being the most important amendment to our constitution? Might the police have another reason? I’m only asking because I don’t know. Do you?

Which brings me to my next point. Donald Trump, himself a staunch supporter of the 2nd Amendment and an opponent of gun control legislation and with the endorsement of the NRA for his candidacy for the Presidency of the United States, says that he has a solution for gun crime in America. And it’s simple. All we have to do is empower the police to stop and frisk bad people and if they find a gun on that frisked person? Take it!

So, if we infringe upon a citizen’s 1st Amendment rights by illegally searching them and then violate that citizen’s 2nd Amendment rights by seizing his or her gun, and then if we deny the due process afforded to citizens in the 5th and 14th Amendments…we can solve the problems of crime and murder in America. It’s so easy you’d think that that Constitutional Amendment hating Hillary What’s-Her-Name would have thought of this already!

And it will be no inconvenience at all (to have our rights infringed) because I know that I’m not going to be stopped and frisked. Just look at me. Do I look like a bad guy? And you know they won’t stop and frisk you because…well, do you look like a bad guy? Certainly not! The police will only be stopping and frisking dangerous and criminal types like…you know, like the ones they have already been accidentally shooting lately.

The only problem I have with Mr. Trump’s plan is: The police could be frisking and disarming suspects right now to find out if they have a gun before shooting them for having a gun, but they can’t seem to get close enough to do so. They always seem to get to the shooting part before the frisking part.

And since our lawmakers, empowered by the NRA, like Mr. Trump, keep making it easier to own and carry a gun in public places how can we also make it illegal to own and carry a gun in public places? That sounds insanely counter intuitive to me. How does it sound to you? And if it is legal to openly carry my gun in 44 states, why do I need to be stopped and frisked at all? Why Can’t I just show the police my gun and be on my way?

Perhaps it is me (or maybe you) that they’re afraid of and not my gun? Or maybe it is the gun? Duh! But then again does the ownership of a gun make only certain folks more dangerous while making other folks not so much? One need only go back to the origins of the 2nd Amendment to figure that one out.

What this November’s election is going to come down to is not whether Americans need better jobs and more secure borders but rather whether or not Americans need to retain their constitutional rights as they pertain to life, liberty and the pursuit of happiness!…especially women, children and all persons of color.

Unless of course for you, “Making America Great Again” means to make America great just for white men… again.

I know how to bring about an end to violent protests and neighborhood rioting and the general unrest that exists between some police forces and many African Americans in our country.

Let’s pass a law in America… that makes it against the law… to kill people.

And then enforce it.

Barnegat Woman Arrested After Threatening Juveniles With Rifle

On December 26, 2014, Chattanooga Police Department Officials said that two victims were stopped at a stop sign when a woman, pulled up next to them in a dark colored sedan and fired a single round into their vehicle. The woman, Julia Shields, struck the radiator and disabled it. After that incident, police began to receive several calls about Ms. Shields pointing her weapon at people as she drove by. Officers were dispatched to try and find the armed, and dangerous, woman and as soon as Shields saw the cops, she fled the scene and sent police chasing after her, leading down several roads
where she continued to point her gun at other drivers as she drove by.

Then when finally cornered and stopped at an intersection she pointed her weapon at the officers…but Ms. Shield was taken into custody without incident or injury and has been charged with 3 counts of Attempted First Degree Murder, 7 counts of Aggravated Assault, Possession of a Firearm during the Commission of a Felony, Felony Evading Arrest, and Felony Reckless Endangerment…and most amazingly…she is still alive!

Meanwhile on December 17th in Barnegat, NJ, near my home town, police received several calls about a female subject standing in the middle of the road and waving a rifle at children while arguing with them over a basketball game they were playing outside her home. Multiple officers responded to the scene where they found Amanda Ponzio and…took her into custody… without incident. The investigation revealed that Ponzio had become engaged in a verbal dispute with the juveniles, then entered her Schooner Avenue home and returned with a Remington 597 rifle, which she then used to threaten the juveniles…but most amazingly…she is now still alive!

Two perpetrators with guns and not one shot fired…by the police! Do these policemen of New Jersey and Tennessee know something that the police in Missouri, Ohio, and New York don’t know? How were these policemen able to take into custody two would-be killers who actually had real guns, and pointed at them, without incident… when those other policemen couldn’t manage to apprehend unarmed perpetrators, one of them a child even, without killing them and without fearing for their own lives?

Was it a New Year’s miracle? Or…Were these two women just not fat and asthmatic enough to warrant the officers disdain? Maybe they just weren’t scary enough to strike fear into the arresting officers souls? Were they just not pointing their actual, real weapons in a menacing enough way to make those policemen fear for their lives? Did they not disrespect the officers enough by using the F word or other nasty words that make grown men cringe in fear? Or perhaps they didn’t act disrespectfully enough to the arresting officials to warrant lethal retaliation? Maybe they hadn’t already committed other crimes, like shoplifting and loitering, to make them seem deserving enough of a public death sentence?

Who knows? I sure as hell can’t figure it out. Can you? But I have learned one thing. It can be done! Officers of the law can apprehend criminals without incident and without deadly force…even in the face of real deadly force, not imagined. Kudos to these brave, courageous and extremely competent police heroes of New Jersey and Tennessee. If only they could teach other officers of the law throughout the United States what it is they know.

And what do you suppose that is?

When it comes to guns and gun laws in the United States of America, things have gotten completely out of hand…case in point:

Responding with his partner to a 911 call about a man pointing a gun at people in a park in Cleveland, Ohio, (Ohio is a traditional open-carry state) Police officer Timothy Loehmann arrived at the scene where he immediately exited his police car and shot 12-year old Tamir Rice.

The open-carry of firearms by those who legally possess the firearm is a legal activity in Ohio with or without a license. Tamir had been playing with an Airsoft replica of a semi-automatic weapon, that, according to the police report, was missing its orange safety cap, which signals that it is fake…but Ohio is an open carry state where the open carrying of firearms is legal.

Tamir died the following day.

Officer Loehmann said that he had no choice but to shoot the child, who he mistook as a 20 year old, because he was pointing his gun.

But, Ohio is a traditional open-carry state where the open carry of firearms is legal. So if you can carry a gun legally out in the open and without a license then is pointing it in any particular direction illegal? And why would a police officer shoot at someone who is carrying a gun since it is perfectly legal for a citizen to carry it in Ohio…and without a license. What law was young Tamir breaking anyway? Even if the orange cap to his fake gun was missing?

And how do you instruct children in the dangers of gun carrying and pointing…when it is perfectly legal for everyone in Ohio to do it? And without a license!? 31 states allow the open carry of firearms without a license or permit.

The only explanation is that while legal, the practice is not common in urban areas, and often results in police responding. Of course urban areas are also areas in which you are more likely to find urban folks of varying colors. Could it be that a white person with a gun is obviously protecting his neighborhood while a person of color with a gun is obviously terrifying his neighborhood? That couldn’t be construed as racist in any way could it?

Guns DO kill people.

Outlaw guns and only outlaws will have guns?

When we Allow “Open Carry”  how can we tell who the outlaws are?

Simply by the color of their skin I suppose?

How to Defeat Aliens and Save the World

Something occurred to me last night while watching television…

If you watch a lot of television like I do (I admit it) then you may have noticed what I have noticed. In all police dramas, police officers always carry handguns and the bad guys that they face almost always carry machine guns of one variety or another. But no matter how many rounds the bad guys fire, they never hit any policemen. And when the police officer finally returns fire he/she always hits his target.

Now, in all science fiction shows the good guys (usually military) almost always carry machine guns (of one type or another) while defending the planet Earth or when traveling to distant worlds (also to defend planet Earth). And the Aliens always use strange and deadly laser weapons of one kind or another. But…no matter how many times those aliens use their powerfully advanced laser weapons they never hit any Earthlings (besides hitting everything else). And when the humans return fire with their machine guns…well, it’s always bad news for the aliens. And no matter what alien race we meet and no matter how advanced their alien species may be, those aliens have never ever seen a machine gun nor developed any defense against them.

Has anyone else ever noticed this?

So handgun defeats machine gun defeats alien, ergo: any policeman could defeat any alien!

According to the United Nations the world employs about 300 police officers for every 100 thousand citizens so that means we have about 21 million law enforcement officers in the world with guns.

This is what 50+ years of watching television has taught me: the planet Earth is safe from aliens!

So, People of Earth, rest easy…at least as far as an alien invasion goes…everything else? Go ahead and worry…
